Affirmative Action, Is It Good Or Bad?

This article does not discuss the legalities of affirmative action, I leave that to the courts. This article is solely about the philosophy of affirmative action.

According to Wikipedia, affirmative action "is a policy or a program promoting the representation in various systems of people of a group who have traditionally been discriminated against, with the aim of creating a more egalitarian society". In my opinion, affirmative action, at least as it has been instituted in this country, is wrong, harmful, racist and prejudicial. Affirmative action, at least in this country, seems to be based, solely, on race or gender.

In example, take two male high school students, both attend the same low income area high school, one is 'black' and one is 'white'. The 'black' student's family, immigrated to this country from Canada fourteen years ago, his father works full time and his mother is a 'stay at home mom'. The 'white' student's ancestors immigrated to this country eighty years ago, his father was killed, in a home invasion robbery, when he was six years old and his mother works part time as a waitress in a diner. The 'black' student has a grade point average of 3.05 with an S.A.T. score of 1085. The 'white' student has a grade point average of 3.55 and a S.A.T. score of 1270. Both students are polite and well mannered. Neither belongs to a gang or has any criminal record. Both want to go to a good university so both apply to U.C.L.A.. Under affirmatve action, which student would be accepted? The 'white' student would not be covered under affirmative action, as 'whites' have not traditionally been discriminated against, and no duty is owed him for being poor and fatherless (being poor and fatherless is not considered disadvantaged and the fact that he attended the same low income school as the 'black' student is also not considered a disadvantage for a 'white'). The 'black student, however, is considered disadvantaged and is considered to come from a race that has traditionally been discriminated against (The fact that his family recently came here from Canada, the fact that he has a parent that works full time and the fact that he has not suffered racial discrimination does not matter.). Under affirmative action, the 'black' student would not only be accepted, he would be eligible for financial aid. The 'black' student would go to U.C.L.A. and the 'white' student would probably end up at a community college.

Change the above example to a 'black student and a 'hispanic' student and the 'black' student would be accepted because 'blacks' rank higher on the disadvantaged charts. Between a 'hispanic' and a 'white' the hispanic would be accepted because 'whites' don't rank on the chart, neither do 'orientals', South East Asians or Jews. The fact that Orientals, South East Asians and Jews have been discriminated against in this country doesn't matter as the 'political correctness' police in this country do not consider them, to have traditionally been discriminated against enough, to be disadvantaged. The only student that would be ranked higher on the disadvantaged chart would be a 'black' female student. Furthermore, a rich 'black' student who attended the best schools would rank the sames as a poor 'black' student who attended a low income school.

Some universities are no longer allowed to use affirmative action as a criteria so they now use 'cultural diversity' as their criteria. To me affirmative action and cultural diversity are the same thing. Both use racial and gender profiling in order to decide who is accepted. This is America and everyone is supposed to be equal and recieve equal treatment. Racial and gender profiling tells people that some races and females are less capable than others and therefore need special help in reaching their potential. Profiling harms this country by telling people that they are not all equal under the eyes of the law. Profiling tells some people that they are not as intelligent or as capable as other people and that they can't make it without help. It tells other people that because they are 'white', they don't deserve help. It rewards some people while punishing other people. This divides the country and causes, in effect, class warfare. America is a land of immigrants who should have been melded into one great class of people, Americans. To tell them that 'blacks', whites', 'hispanics', 'orientals', etc. are all different and have different abilities keeps this country from being united. To grant advantages to one group over another is discriminitory and divisive. To tell 'blacks', 'hispanics' and others that they can't make it without outside help is to tell them that that they are not as capable as 'whites', 'orientals' and others.

Some of you may be wondering why I keep placing single quotation marks around certain words like 'black', 'white', etc.. It is because I do not like using labels like 'black' and 'white' to describe people. Other words like 'hispanic' are, in my opinion, used improperly as they tend to catagorize people from many different countries or groups into one group. All 'blacks' are not the color of black, all 'whites' are not the color of white and all 'hispanics' are not necessarily of Spain or Spanish speaking (Brazilians, for example, are classified 'hispanic' even though they speak Portuguese and most are descended from Portugal or some African country.). As far as I am concerned all people that are American citizens (naturalized or other) or live permanently in the United State Of America are either American citizens or American residents. To label them otherwise is to denigrate, isolate and seperate them from each other. Discussing concepts, like affirmative action and cultural diversity, force the use of such labels.

The people of this country need to be brought together, not seperated. Being proud of your ancestors and your heritage is one thing, being rewarded, punished or seperated because of your ancestors or heritage is something else entirely. Being rewarded because others of your race or gender were mistreated in the past is wrong and being punished for what others of your race or gender did in the past is equally wrong. How would you like to be fined for horse stealing because you are a 'white' male and some other 'white' male stole a horse over fifty years ago or even last week? Untill all people in this country are treated equally, and with the same respect, and are given the same chances, we will never be "One nation under God, indivisable, with liberty and justice for all". Discrimination is wrong, no matter who is being discriminated against.

Note: For any of you that object to my keeping the phrase "under God" in that last quote, tough. That is the way I say it. If you don't want to say it that way, then don't. Just don't try to tell me that I can't say it that way. To those of you that object to my using the word 'black' instead of the words 'African-American', again I say tough. To me 'African-American' is just as much a misnomer as 'Hispanic'. I believe that the word 'black' is improper, however, I hate to use the word American when there is a hyphen before it. To me an American is an American. I didn't write this article to be 'politicaly correct', I wrote this artice in order to say what I think. If you want 'political correctness', go elsewhere.

Review: Unbridled Injustice Authored By Ellie Boatman

It was Charles Dickens who stated in his famous novel Oliver Twist, ?the law is an ass,? and perhaps in some instances we would have to agree with him. However, what is even more alarming is when judges are bigger asses when they exhibit judicial bias or they abuse their wide discretionary powers that is accorded to them within the family court system. They may even, in certain instances, look the other way when there is a question of attorney ethics. All of this leads to a violation of due process that every citizen is entitled to under our democratic legal system. Such denial of justice was experienced by Ellie Boatman Conger, principal protagonist in Ellie Boatman's debut novel, Unbridled Injustice.

Many authors have turned to fiction to provide a beacon of enlightenment in understanding bitter struggles during dark times, and Boatman is no exception, as she uses this genre very effectively in narrating how one woman from Kentucky had been wronged by the judicial system.
Set against Lexington Kentucky's equestrian community, the novel tells the story of Ellie, who after vacationing for a week in Florida with close friends, arrives home at the airport only to be greeted with a divorce petition from her husband Roy. This comes as quite a shock to a woman who believed that life could not be sweeter. After all, she had three great children, a successful husband, a gorgeous home and farm that included several prized ponies, and the respect of her hometown social community.

However, all is not as it appears and as Ellie asserts, ?sometimes our lives are like sleepwalking. When we finally awaken we have no idea where we are and even less how we managed to get there.?
Shortly after receiving the divorce petition, Ellie finds herself embroiled in very nasty and costly judicial proceedings that could mean the loss of custody of her children to her husband. To further aggravate this frightful situation, Ellie regrettably engages a young and inexperienced attorney, who was not too swift on his feet and consequently is outmaneuvered by the unethical tactics and devious behavior of his opponent, who uses every trick in the book to make life miserable for Ellie. Adding a little more drama into the narrative is the grotesque possibility of child molestation that is ignored by a judge, who has her own agenda, and a lazy social worker assigned to the case.
For a first time author, Boatman shows a great deal of confidence in her story- telling abilities, although at times the pony show scenes wear a bit thin, slowing down the pace of the novel. Nonetheless, this hard-hitting narrative is a page turner not only because of its plot, but also the strong message it conveys. Conger gets top marks for her clarity and richness of voice, all of which contribute to the reader's ease in empathizing with Ellie's anger and despair, as she  fights the sometimes unfairness of the judicial system in order to gain the custody of her children. Each copy sold, increases his war chest and teaches consumers, who get no respect in the marketplace, how by taking small but effective steps in daily lifestyle, we can drive greedy murderers out of the marketplace. Maybe even prevent them from exporting their sickness and disease to the poor countries which already have more than they need from chronic malnutrition and foul water.

His book can save and lengthen your life and improve it's quality from the time you take your first small steps. He will surely become the clearing house and testing mechanism for many new alternative health discoveries coming down the road. He has already begun organizing alternative health care providers by creating directories on the subscription portion of his website; Natural Cures.com. He knows marketing and will multiply his company profits as he increases the profitability of organic food marketing, water purification products, energy field generators and all the tested and proven alternatives to toxic food and medicine. Intellectual Property will soon be History

It is not too risky to affirm that intellectual property will soon be History.

Rules designed for the paper era are not useful, enforceable and cost-economic in the Web era.

Here are a few reasons:

1) Intellectual property is not designed for the Web times

I strongly believe that intellectual property will soon be history, not because Anarchism will succeed over Capitalism, but because the Net Economy will find new ways to control ownership of words and patents.

Words alone are mostly worthless. Nobody is able to make money out of them anymore. Let's take someone whose words are unique and valuable: Gabriel Garcia Marquez, for instance. He collects some royalties from his writings, except for:

- the 50% cut that makes his publisher - the 40% lost to piracy - the 5% cut from the book physical maker - 3% from government taxes -1% from his agent, lawyer and accountant

So, the Paper Economy offers him 1% of the potential profit from his words.

On the other hand, what happens when you write for the Web?

Most word-content websites have lost money permanently since the 2000 Net Bubble. Even for prime authors, like Rawlings and her Harry Potter, plagiarism has eaten half of the earnings.

Making money out of words in the web takes a little more than writing. You need to point the words to those that might buy something related to them. You also need to secure some form of collecting money and measuring your response rates. The webmaster and the site promoter replace here the publisher.

2) Writing for the Web is different than writing for paper

There are:

- few authors that know how to write for the Web (short, focused, adjustable to the reader preference, keyword-dense, sticky, connected with a merchandise or service)

- few publishers that know how to make money in the Web starting from printed words from the paper era

- few webmasters who can transform electronic words in non-electronic dollars, either dealing with authors or conventional publishers

The Web Word Market is more dynamic, focused and automated than the Paper Word Market. In the past, the unit was the book, because you needed to print it, distribute it and sell it. Now, the unit is the web page, a much smaller one. Or maybe the RSS feed, the article, the forum posting or other smaller dynamic forms.

3) Authors are not so valuable in the Web Economy

Names and brands are less important in the web, because nobody spends too much time in one place, and the average user looks for specific answers rather than just a pleasant reading time.

Can you name a single Web author that always calls your attention? Are there any Web equivalents to Garcia Marquez or Norman Mailer? There are blog authors that have followers, but their names are not relevant. And the blogs with its traffic can easily be sold to someone else.

By the way, names and pen names are out. A famous person in my own field (SEO, or search engine optimizing) is GoogleGuy. A good, sticky name with 2 relevant keywords in it. I don't care if his real name is John Smith or Anand Brahmaputra. My own name is Sergio Samoilovich, but I would like to change it to Synonymizer, for e-marketing purposes. When I was trying to sell my netic.com domain I signed Neticman. I own many domains related to different products I sell. I might also own as many virtual names.

And how about pen names similar to Indian names: Man-who-blogs-for-a-living, Webcam-Girl, Pervasive-Word-Marketer or the like...

Targeting the right audience and positioning your website in the Search Engines under the proper keywords is more important than winning a Nobel Prize or a famed contest. Success is now measured in ad revenue rather than books sold.

My point is that in the Web, being the author of something is not that important. What is important, is to own targeted traffic that can buy a product by that author or any other. You can always find an author offering his product thru an Affiliate program, which equals sharing profits with you, the e-marketer. Experts can turn a bad author into good web stuff.

4) Plagiarism is not well defined

So far, there is not linguistic or mathematic rule for plagiarism. It is up to the lawyers to define fair use or unfair use. This makes litigation very difficult. Some guidelines are mentioned usually in University sites, advising students not to use other's words without permission, but they rarely express a numeric limit between quoting and plagiarizing.

Besides, some plagiarism rules are non-enforceable.

For instance, there is a problem when you plagiarize a short text without noticing it. To prevent that, there should be a central database or clearinghouse in the Web that you could run your text against, in order to validate it. If I used a phrase like 'New York Times' I will probably will run into the newspaper attorneys, even if I was thinking about the weather in the big apple.

5) Plagiarism is not easily detectable.

It is also a complication the fact that the web is a dynamic medium, and there are no hard proofs of most infringements.

Plagiarism is non-detectable when the author makes slight modifications in the copied text. There is no computer in the world able to read the whole Web and find all the similar phrases or web pages. The main plagiarism detection systems work by sampling the suspected originals and copies, and those small samples can be wrong: either false positives or false negatives are possible.

Software like Synonymizer makes it easy for webmaster to create almost-duplicate text, barely detectable for the search engines.

Finding plagiarists and punishing is very difficult. The web is mostly distributed and anonymous.

Thus, a significant business is surging from the plagiarism-detection needs of authors, universities and publishers.

6) Google is the leader in electronic detection and punishment of plagiarism

So far, Google has some filters that reject duplication from its index, and attempt to give credit to the original author.

For me, it is obvious that some software should take care of the plagiarism issues, instead of the expensive and unpredictable lawyers and judges. With previsions for Synonymizing.

Some kind of web service (the Web Economy) will rate the originality of your words, the value for the customers, the degree of infringement of the laws, and will provide you a reward : traffic that you can monetize. Or a punishment: exclusion from the main listings.

Garcia Marquez could profit from AdSense and other ad servers, and there would be little intermediation.

Maybe a small 'Plagiarism Algorithm' in Google and Yahoo can and will replace Intellectual Property Lawyers... It will be cheaper, faster and radically more effective.
